1. 2. FILING A DMCA TAKEDOWN NOTICE If you believe that content on the Platform infringes your copyright, you may submit a DMCA takedown notice containing: (a) Your physical or electronic signature; (b) Identification of the copyrighted work you claim is infringed; (c) Identification of the infringing material and its location on the Platform; (d) Your contact information (name, address, phone, email); (e) A statement that you have a good faith belief that use of the material is not authorized; (f) A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
3. PLATFORM RESPONSE Upon receiving a valid DMCA notice, creavio will: (a) Remove or disable access to the allegedly infringing content within 48 hours; (b) Notify the Creator whose content was removed; (c) Provide the Creator with a copy of the takedown notice.
4. COUNTER-NOTIFICATION If your content was removed and you believe it was removed in error, you may file a counter-notification containing: (a) Your physical or electronic signature; (b) Identification of the removed content and its former location; (c) A statement under penalty of perjury that you have a good faith belief the content was removed by mistake; (d) Your name, address, and phone number; (e) Consent to jurisdiction of the federal court in your district; (f) A statement that you will accept service of process from the original complainant.
5. COUNTER-NOTIFICATION PROCESS Upon receiving a valid counter-notification, creavio will: (a) Forward the counter-notification to the original complainant; (b) Wait 10-14 business days; (c) If no court action is filed, restore the removed content.
6. REPEAT INFRINGERS creavio will terminate the accounts of users who are determined to be repeat infringers. Three valid DMCA takedown notices within a 12-month period will result in permanent account termination.
7. MISREPRESENTATION Under the DMCA, any person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Do not file false DMCA notices.
8. SAFE HARBOR creavio operates as a service provider under 17 U.S.C. 512. We do not monitor, screen, or review Creator Content before it is published. We rely on the notice-and-takedown procedures described in this policy to address copyright infringement.
